Easement Maintenance Agreement


An easement maintenance agreement is signed between two parties where one gets the right to use the property of another in order to gain access to and perform maintenance work for a building, road, drainage system and so on. The owner of the property retains all rights to the said piece of property although he allows the other party to use it for maintenance duties.

Sample Easement Maintenance Agreement

This maintenance agreement is made between PARTY 1 and PARTY 2 on the effective date of July 25, 2011 in Ohio, whereby the PARTY 1 shall be providing PARTY 2 access to the drainage system for maintenance services.

TERMS AND CONDITIONS:

  • PARTY 1 grants PARTY 2 easements for the right to use his property for maintenance work for the area’s drainage system
  • PARTY 2 hereby gets all detention, retention and stormwater facilities
  • PARTY 2 shall strive to protect the general public from flooding and pollution of the water by maintaining, modifying or replacing the drainage if there is a problem
  • PARTY 1 shall retain all rights to the property
  • Since the easements would prevent PARTY 1 from making economically viable usage of the site, he can apply to the Director of Planning and Development Services for a minimum allowance to modify certain easement requirements.
  • No structure can be built on the drainage easement site
